Terms of Service

These Terms of Service ("Terms") govern your use of The Muster App and Muster Mate applications and related services (together, the "Service") operated by The Muster App Ltd ("we", "us", or "our"). By using the Service, you agree to these Terms.
In these Terms: The Muster App is the iPad application used on board a vessel (for visitor check-in/out, the crew board, muster drills, safety documents, security/ISPS, checklists and policies); Muster Mate is the companion application installed on the personal phones of individual crew members; the vessel operator is the owner, operator, or manager who subscribes to the Service for a vessel and is responsible for that vessel's account; a vessel administrator is a person authorised by the vessel operator to manage the account; and you means the person or organisation agreeing to these Terms, whether a vessel operator, vessel administrator, or an individual crew member using Muster Mate. Where you accept these Terms on behalf of a vessel operator or other organisation, you confirm that you are authorised to bind that organisation.
1. Description of Service
The Muster App is a maritime safety and crew management application designed for use on vessels. The Service provides tools for visitor check-in/out, crew management, muster drills, safety document management, and related vessel safety operations.
Muster Mate is a companion application for individual crew members. It provides tools that may include hours-of-rest records, deliveries, daily safety briefs, muster duties, and push notifications. The Service is a supplementary administrative and record-keeping aid. It is not a navigation, watchkeeping, alarm, detection, life-saving, or emergency-response system. Please read Section 1A (No Reliance) before relying on any feature of the Service.
1A. No Reliance — The Service Is Not a Guarantee of Safety or Compliance
Read this section carefully. It is fundamental to your use of the Service. The Muster App and Muster Mate are supplementary digital aids only. They do not, and are not intended to, ensure the safety of any vessel, crew member, visitor, or other person, and they do not guarantee compliance with any law or regulation.
You acknowledge and agree that:
- The Service is a supplementary tool, not a safety system. It is an aid to administration and record-keeping. It is not a navigation, watchkeeping, alarm, detection, life-saving, or emergency-response system, and it must never be treated or relied upon as one.
- The Service is not a guarantee of safety or of life. We do not warrant or represent that use of the Service will prevent or reduce any accident, injury, loss of life, fire, flooding, person overboard, grounding, collision, security incident, or any other harm or emergency.
- The Service is not a guarantee of regulatory or statutory compliance. Use of the Service does not, by itself, achieve, demonstrate, or maintain compliance with any legal or regulatory requirement, including but not limited to the Maritime Labour Convention 2006 (MLC), the International Safety Management (ISM) Code, the International Ship and Port Facility Security (ISPS) Code, the International Convention for the Safety of Life at Sea (SOLAS), and any requirement of your flag State, classification society, port State control, or other competent authority. Features that reference these regimes are provided to assist your own compliance processes only; responsibility for compliance remains entirely yours.
- The Service does not replace mandatory equipment, people, or procedures. It does not replace, and must not be used in place of, statutory or mandatory safety and life-saving equipment, qualified and certificated watchkeeping, the professional judgment and lawful command of the master, the conduct of physical drills and musters, or your vessel's approved Safety Management System (SMS) and its documented procedures. Statutory records, certificates, and procedures required by law remain mandatory regardless of any record held within the Service.
- The master and operator remain solely and fully responsible at all times. The owner, operator, manager, and master of the vessel retain sole and full responsibility for the safety of the vessel and all persons aboard, for watchkeeping and the safe operation of the vessel, and for compliance with all applicable laws, regulations, and the vessel's SMS. Nothing in the Service transfers, reduces, or discharges that responsibility.
- You must not rely on the Service as a sole or primary source. You must not use or rely on the Service as the sole or primary means of making, recording, or evidencing any safety-critical or compliance-related decision. Any output of the Service should be independently verified against authoritative sources and the vessel's own procedures before it is relied upon.
- Data and features may be delayed, wrong, or unavailable. Information, notifications, position data, rest-hours and other calculations, checklist and policy status, muster and drill records, and any other output of the Service may at any time be delayed, incomplete, inaccurate, out of date, or unavailable, for reasons including loss of connectivity, device failure, third-party service outages, user error, or factors beyond our control. Push and other notifications are not guaranteed to be delivered, delivered on time, or delivered at all, and must not be the only means by which a safety-critical alert or instruction reaches a person.
If any conflict arises between the Service and the requirements of applicable law, your flag State or classification society, the manufacturer's instructions for any equipment, or the lawful instructions of the master, those requirements and instructions prevail and must be followed. Your statutory rights, where they apply, are not affected by this section.
2. Account and Access
Access to the Service requires authorization by a vessel administrator. Each device must be registered and approved using a vessel-specific access code. You are responsible for:
- Maintaining the confidentiality of your access credentials
- All activities that occur under your account or device
- Notifying us immediately of any unauthorized use of your account
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers connected to the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to collect or store personal data about others except as intended by the Service's features
- Share access codes or credentials with unauthorized parties
4. Data and Content
You retain ownership of all data you submit to the Service, including visitor records, crew information, safety documents, and photographs. By using the Service, you grant us a limited license to process and store this data solely for the purpose of providing the Service.
You are responsible for:
- The accuracy and legality of data you submit to the Service
- Obtaining necessary consent from individuals whose data you collect using the Service
- Complying with applicable data protection laws in your jurisdiction
- Maintaining your own backups of critical data
5. Audio Recording Feature
The Service includes an optional audio recording feature for muster drill sessions.
- Purpose: Audio recording is provided to support compliance with maritime safety regulations, including documentation of emergency drill procedures as required by the ISM Code and SOLAS Convention
- Vessel Operator Responsibilities: If you enable audio recording, you are responsible for informing all persons present during a recorded muster session that recording is taking place, obtaining any consent required by applicable law, and complying with all applicable recording and privacy laws in your jurisdiction
- Controls: Audio recording is disabled by default. Vessel administrators may enable or disable it at any time. Recordings can be deleted by the vessel administrator at any time, and muster audio recordings are also automatically deleted after the retention period configured for your vessel
- Restrictions: You must not use the audio recording feature for surveillance, to record private conversations without consent, or for any purpose other than documenting muster drill sessions
6. Optical Character Recognition (OCR)
The Service uses on-device optical character recognition technology to extract text from documents during visitor onboarding and vehicle checkout processes, including identification documents and driver's licences.
- Best Effort: OCR is provided as a convenience to speed up data entry. While we strive for accuracy, optical character recognition is inherently limited by factors including image quality, lighting conditions, document condition, and text formatting. Results may be incomplete or inaccurate
- Administrator Responsibility: Vessel administrators and operators are responsible for reviewing and verifying that any information captured via OCR is correct before relying on it. The Service retains the original captured image alongside any extracted text for verification purposes
- Compliance: Administrators should ensure that the captured data meets their own compliance and record-keeping requirements. OCR output should not be treated as authoritative without manual verification
- No Guarantee: We do not guarantee the accuracy, completeness, or reliability of any text extracted via OCR. The feature is provided "as is" and should be used as a supplementary tool, not a replacement for manual document review
6A. AI-Assisted Features and Plan Allowances
Some parts of the Service use artificial intelligence to help you create content — for example generating draft training courses, suggesting matches during imports, or summarising documents.
- Drafts, Not Finished Facts: AI-generated output is a starting point for you to review and edit. You are responsible for checking that any AI-generated content is accurate, appropriate and suitable for your vessel before publishing or relying on it. Section 1A (No Reliance) applies in full to AI-generated content
- Usage Allowances: AI-assisted features may carry usage allowances that vary by subscription plan (for example, a set number of AI-generated courses included in a given plan). Current allowances are shown in the Service at the point of use
- Allowances and Availability May Change: We may introduce, adjust, or remove usage allowances, and may change which subscription plan or tier includes a given AI-assisted feature — including moving a feature to a higher tier — at any time as the Service evolves. Where a change materially reduces an allowance or feature you actively use, we will where practical give reasonable notice or apply the change from your next renewal
- No Refund for Changes: Changes to AI allowances or feature-tier placement do not give rise to a refund, except as set out in Section 9 or where you have a statutory right
- Third-Party Models: AI features may be powered by third-party AI providers. Content you submit to an AI feature (such as a document used to generate a course) may be processed by those providers to deliver the feature, as described in our Privacy Policy
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect information. By using the Service, you consent to the practices described in the Privacy Policy.
8. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
Certain features of the Service rely on third-party data feeds and infrastructure. Where this is the case, availability and accuracy depend on those external providers and are outside our direct control. We provide such features on a best-effort basis only.
In particular, the Tender Tracker feature relies on vessel position data delivered by Peplink InControl 2 from Pepwave routers installed on the vessel and tenders. We do not own, operate, or control this hardware or telemetry service. Position data may be delayed, incomplete, inaccurate, or unavailable at any time, including but not limited to loss of cellular coverage, hardware power-down, the device being switched off, third-party API outages, or changes to Peplink's services. Tender Tracker is provided as a situational-awareness aid only and must not be relied upon for navigation, search and rescue, or any safety-critical decision.
Some subscription plans reference custom or bespoke integrations with third-party hardware, telemetry, or services — for example onboard networking equipment, vessel data systems, or external APIs. Such integrations are not a standard or guaranteed component of any subscription. They are offered subject to technical feasibility, the equipment and connectivity installed on your vessel, applicable third-party terms and availability, and our development capacity at the relevant time. We do not warrant that any specific integration can or will be provided, and the absence of a particular integration is not a defect in the Service. We recommend that prospective Pro subscribers contact us before purchasing to confirm what is achievable for their vessel.
Important: The Muster App is a supplementary safety tool. It does not replace mandatory safety equipment, procedures, or regulatory requirements. Vessel operators remain fully responsible for vessel safety and compliance with all applicable maritime regulations regardless of their use of the Service.
9. Fees, Trials, and Refunds
The Service is offered on a subscription basis with the following terms:
- Free Trial: New accounts receive a 14-day free trial with full access to the Service. No payment information is required during the trial period
- Subscription Billing: After the trial period, continued use requires an active subscription. Subscriptions are billed annually in advance
- Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until the end of your paid period
- Refunds: Subscriptions are billed annually in advance and are non-refundable once payment has been taken, except where you have a statutory right to cancel or to a refund (for example a consumer cooling-off right) or where we agree otherwise. The 14-day free trial is provided so that you can evaluate the Service in full before any payment is due. We do not offer an automatic or guaranteed refund and do not operate a money-back guarantee. We will correct genuine billing errors, such as a duplicate or incorrect charge. If you wish to ask us to consider a refund in your particular circumstances, contact support@themusterapp.com; any such refund is considered case by case and granted at our sole discretion. You may cancel at any time to stop future renewals (see Cancellation above). Your statutory rights, where they apply, are not affected. See our Refund Policy for further detail
- Price Changes: We may change subscription prices with 30 days' notice. Price changes take effect at your next renewal date
10. Intellectual Property
The Service, including its design, code, features, and documentation, is owned by The Muster App Ltd and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
Our Help Center, documentation, and support articles are provided for general guidance only. As the platform is actively developed and updated, help content may not always reflect the most current version of the Service. In the event of any discrepancy between help content and the actual behaviour of the Service, the Service as delivered shall prevail.
12. Limitation of Liability
To the maximum extent permitted by applicable law, The Muster App Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your access to or use of or inability to use the Service
- Any conduct or content of any third party on the Service
- Unauthorized access, use, or alteration of your data
13. Indemnification
You agree to indemnify, defend, and hold harmless The Muster App Ltd and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.
14. Termination
We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason at our sole discretion.
Upon termination, your right to use the Service will cease immediately. You may request a copy of your data within 30 days of termination.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify vessel operators of material changes by email or through the Service. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
17. Miscellaneous
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and The Muster App Ltd regarding the Service
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect
- Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction
18. Third-party content and public sector information
The Service may surface safety-related content published by third parties. Where the Service displays Marine Guidance Notices (MGN / MIN / MSN) issued by the Maritime and Coastguard Agency, or accident investigation reports published by the Marine Accident Investigation Branch, the original documents are served directly from the gov.uk website in an in-app browser and are subject to Crown copyright.
Titles, publication dates, summary snippets and metadata relating to these documents are displayed inside the Service under the terms of the Open Government Licence v3.0.
Editorial summaries, AI-generated “Recommended Read” rationales, feature categorisations and any other commentary authored by The Muster App Ltd remain our copyright and are not authored by or endorsed by the issuing authority.
