These Terms of Service ("Terms") govern your use of the Muster application and related services (the "Service") provided by The Muster App Ltd ("we", "us", or "our").
By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Description of Service
The Service is a vessel safety and visitor management platform that enables:
- Visitor check-in/check-out tracking
- Emergency muster management
- Crew management
- Safety document storage and distribution
- Badge generation for visitors
2. Account and Access
Vessel Accounts
- Vessel operators must register for an account to use the Service
- You are responsible for maintaining the confidentiality of your access credentials
- You are responsible for all activity that occurs under your account
Device Authorization
- Devices must be authorized by vessel administrators to access the Service
- Unauthorized devices will not have access to vessel data
- You may revoke device authorization at any time
3. Acceptable Use
You agree NOT to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or other users' data
- Interfere with or disrupt the Service
- Share access credentials with unauthorized parties
- Upload malicious content or files
- Use the Service to harass, harm, or discriminate against individuals
4. Data and Content
Your Data
- You retain ownership of all data you input into the Service
- You grant us a license to store, process, and transmit your data to provide the Service
- You are responsible for the accuracy and legality of data you collect
Visitor Data
- You are responsible for obtaining appropriate consent or having lawful basis for collecting visitor data
- You must inform visitors that their information is being collected for safety purposes
- You are responsible for responding to data subject requests
Safety Documents
- You are responsible for ensuring uploaded safety documents are accurate and current
- We do not verify the content or accuracy of uploaded documents
5. Audio Recording Feature
The Service includes an optional audio recording feature for muster (emergency drill) sessions.
Purpose
Audio recording supports compliance with maritime safety regulations, including:
- International Safety Management (ISM) Code requirements for emergency preparedness
- Safety of Life at Sea (SOLAS) Convention drill documentation requirements
- Vessel safety audits and incident investigation
Vessel Operator Responsibilities
If you enable audio recording, YOU are responsible for:
- Obtaining Consent: Informing all persons present that audio recording is active and obtaining appropriate consent as required by applicable law
- Signage/Notice: Providing clear notice (verbal announcement, signage, or other means) before recording begins
- Compliance: Ensuring recording complies with local laws in the vessel's flag state and any jurisdictions where the vessel operates
- Data Requests: Responding to requests from recorded individuals to access or delete their recordings
Controls
- Audio recording is disabled by default
- Vessel administrators may enable or disable recording at any time
- Recordings can be deleted by vessel administrators
- Recordings are automatically deleted after the configured retention period
Restrictions
Audio recording may only be used for:
- Emergency drills and muster sessions
- Safety training documentation
- Incident investigation and audit purposes
Audio recording must NOT be used for:
- Surveillance of crew or visitors during normal operations
- Any purpose unrelated to vessel safety
We reserve the right to disable audio recording for any vessel that misuses this feature.
6. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you agree to our Privacy Policy.
7. Service Availability
- We strive to maintain high availability but do not guarantee uninterrupted service
- The Service may be unavailable during maintenance, updates, or due to circumstances beyond our control
8. Fees, Trials, and Refunds
Free Trial
- New accounts receive a 14-day free trial with full access to the Service
- No payment is required during the trial period
- You may cancel at any time during the trial without charge
Subscription Billing
- After your trial ends, subscription fees are billed in advance (monthly or annually, depending on your selected plan)
- Payment is processed by our payment provider, Lemon Squeezy
- You authorize recurring charges until you cancel your subscription
Cancellation
- You may cancel your subscription at any time through your account settings or by contacting us
- Upon cancellation, you will retain access to the Service until the end of your current billing period
- Your subscription will not renew after the current period ends
Refund Policy
- No refunds are provided after payment has been processed
- The 14-day free trial allows you to fully evaluate the Service before committing to payment
- If you are dissatisfied, cancel before your trial ends or before your next billing cycle to avoid further charges
- Refunds may be considered at our sole discretion for exceptional circumstances
Price Changes
- We may change subscription pricing with 30 days advance notice
- Price changes will take effect at your next billing cycle after notice is given
- If you do not agree to a price change, you may cancel before it takes effect
9. Intellectual Property
- The Service, including its design, code, and branding, is owned by The Muster App
- You may not copy, modify, or reverse engineer the Service
- Feedback you provide may be used by us without obligation to you
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
WE DO NOT WARRANT THAT:
- The Service will be uninterrupted or error-free
- The Service will meet your specific requirements
- Data will not be lost or corrupted
- Mandatory safety equipment
- Required safety drills and procedures
- Official vessel documentation
- Professional safety training
- Regulatory compliance obligations
Vessel operators remain solely responsible for vessel safety and regulatory compliance.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM
- WE ARE NOT LIABLE FOR DAMAGES ARISING FROM SERVICE UNAVAILABILITY DURING EMERGENCIES
12. Indemnification
You agree to indemnify and hold harmless The Muster App from any claims, damages, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your collection or processing of visitor data
- Claims by visitors or crew related to data you collected
13. Termination
By You
You may stop using the Service at any time. Contact us to delete your account and data.
By Us
We may suspend or terminate your access if you:
- Violate these Terms
- Fail to pay fees when due
- Use the Service in a way that harms others or the Service
Upon termination, your right to use the Service ends. We may delete your data after 30 days unless you request an export.
14. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.
16. Miscellaneous
- Entire Agreement: These Terms constitute the entire agreement between you and us
- Severability: If any provision is unenforceable, the remaining provisions remain in effect
- Waiver: Failure to enforce a provision does not waive our right to enforce it later
- Assignment: You may not assign these Terms; we may assign them in connection with a merger or acquisition
